Terms Of Use

This document outlines the terms of use of The Divers Log  ("The Divers'Log", "us", "we" or "our"). When using the website and/or completing a reservation through The Diver's Log you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).

• Introduction

Terms & Definitions for the words we use: 

Agent: The Diver's Log acts as an agent on behalf of the operator. Therefor, offering marketing and reservation services to the operator, at an agreed commission rate. 
Best Price Guarantee: The Diver's Log guarantees to give all guests the lowest price possible for their liveaboard diving and/or adventure cruise holiday. 
Cancellation fee: The amount charged to the guest in case a reservation is cancelled by the guest.
Booking Voucher: An electronic receipt sent to the operator and guest to confirm bookings.
Force Majeure Event: An event that is beyond the control of the operator or the agent, such as natural disasters, political unrest, etc. 
Guest: Anyone going on a trip offered by the operator.
Operator: The entity that operates and offers liveaboard diving trips and/or other products offered through the agent.
Price: The amount of money shown to the guest on the website when making a reservation. 
Product: A liveaboard diving trip or a liveaboard adventure cruise including place in cabin and all features (and/or extras, if available) that are stated as included by the operator. 
Reservation: The Agreements between operators and guests. We facilitate this agreement and hold no responsibility for the product supplied by the operator to the guest. 
Website: The website www.thediverslog.com including all pages. Mobile or tablet versions of the website are also included in the definition of website..

1. Reservations
1.1 The Diver's Log provides is an intermediary agent and charges a fee accordingly to the operator. The reservation forms an agreement between the guests and the operator. We are not a party in this agreement.
1.2 Reservations are made online through our website, or Social Media Channels, and are subject to the availability of the requested product of the operator.
1.3 Our service is free of charge to the guest. Our commission in charged to the operator, and should not affect the guest in any way.
1.4 The Diver's Log is responsible for the execution of the reservation, but not for the product supplied by the operator.
1.5 In some cases, extra information (i.e, passport copies, evidence of guest insurance, copy of diver's license or certificate, health certificates, flight details, etc.) is needed to make a reservation complete. We hold the right to cancel the reservation according to the applicable booking policy for the particular booking in case this information is not supplied by the guest.

2. Responsibility of the guest
2.1 The guests are responsible for transportation to and from the mooring location of the liveaboard or cruise boat. We may offer recommendations for airlines, hotels and transfer options, but we are not affiliated with these companies and are not held responsible for their services.
2.2 Guests are responsible to meet the health and disability requirements defined by the operator, and conduct any required health checkup by a healthcare professional if they book a diving trip. Guests must notify us in writing at the time of booking of any physical or mental illness, disability or other conditions for which special accommodations or the use of a wheelchair is necessary or contemplated.
2.3 Participation in diving activities requires certification by official and recognized organizations such as PADI to make sure you have all necessary skills for safety and enjoyment during a diving trip. The guests themselves are responsible to meet the minimum required logged dives standard of each diving trip. Guests are responsible to get relevant and appropriate training before going on any trip.
2.4 Guests are responsible for their own insurance, ensuring it covers adventure travel and sports (for example insurance provided by DAN network or World Nomads) so as to be protected in case of dive accidents or other adventure-travel related risks. The Diver's Log is in no case held responsible for any incident.
2.5 The guest agrees to respect the rules of the operator and acknowledges that if the rules of the boat are broken, the operator (or captain) has the right to deny entry on board, deny diving activities or any of the activities offered by the operator, or take any action that they see fit.
2.6 The guests themselves are responsible to meet all requirements (i.e Passport, Visa, Health Insurance) to enter the country or countries where the trip is organized.
2.7 We strongly advise our guests to review travel prohibitions, warnings, announcements and advisories issued by their governments, prior to their departure.
2.8 The guest should inquire about vaccination and prevention of tropical ailments with a doctor and follow their advice. We cannot provide medical advice.
2.9 If for any reason you are delayed in transit and fail to reach the liveaboard or cruise boat by the scheduled time of departure, you will be responsible for all costs involved in catching up with the boat (if possible to arrange this locally), staying at onshore accommodations, alternative diving arrangements etc. For your safety, we recommend you to travel at least a day early, and have an extra day on land before the day of the return flight. We can only offer suggestions for hotels and locations, but are not held responsible.

3. Special Requests
3.1 During reservation, the guest can make special requests. These requests may need additional information and will be agreed upon in communication between the operator and the guest. The Diver's Log is in no situation responsible for the availability or condition of special requests (i.e equipment rental, dietary requests, on board purchases, diving courses, special cabin requests, etc).
3.2 We highly recommend guests to bring their own gear as this will contribute to a better diving experience. We do advise guests to rent an additional diving computer in case one breaks down, to prevent not being able to dive for 24 hours.
3.3 Special dietary requests may be communicated in advance. We recommend to limit these requests to necessary diet requirements only (e.g. due to religious beliefs or allergies).
3.4 For airports pickup, please contact the operator directly with your voucher and/or reservation number to confirm flight number, arrival time and meeting point. The Diver's Log does not take responsibility for airport transfers.

4. Payments
4.1 Bookings are only valid and confirmed when full payment is received.
4.2 All payments are made by direct bank transfers to the booked trip operator. The Diver's Log does not collect booking payments or fees.
4.3 After payment has been received, The Diver's Log will send you a Booking Voucher to the email address you provided. This serves both as proof of your booking and as an invoice for your administration. Please bring a copy (digital or physical) with you when boarding the cruise and also keep a copy for future reference.
4.4 The Diver's Log reserves the right to charge the extra costs incurred for payments that are not performed correctly (i.e credit card charge-backs and/or non-OUR bank transfers).
4.5 Full amount is due on date of reservation. If you require the payment to be made in deposits, please contact us on info@thediverslog.com to check availability and arrangements. Extra fees for the extra bank and administration cost will be charged.
4.6 All our rates are charged in USD. Quotations in other currencies are for reference only.

The Diver's Log is not responsible for exchange rates at the time of payment.

5. Cancellation & Amendments
5.1 Different cancellation policies apply to each reservation. The guest needs to check and agree with the specific booking conditions for each trip.
5.2 No show, early departure from a trip, or cancellation after refund deadlines are subject to NO Refund Policy.
5.3 In case of a booking amendment request we will contact the operator, and do our best to help you find a suitable alternative trip. (Depending on availability of operators).
5.4 In case of amendment or cancellation with a (partial) refund we will apply a 5% administration fee (to cover our credit card, bank transfer and/or handling costs incurred), to be added to the cancellation policy as described under 5.1. This fee is calculated on the total amount of the reservation. Cancellations always need to be submitted in writing by email (info@thediverslog.com) to avoid misunderstanding.
5.5 If the vessel is not in condition to sail or if there are any delays in the dry-dock or last minute maintenance required, the operator has the right to operate the same itinerary with a different vessel. In this case the customers have to accept the change of vessel. If the standard of the vessel lacks important facilities, compensation can be made, but this is not an obligation. The Diver's Log is in no case responsible for such incident.
5.6 The operator has the right to replace the vessel and operate the same itinerary as long as the vessel offers similar standards as the liveaboard or cruise boat that was initially booked by the guest.

The Diver's Log will not be liable for disputes arising out of the appointment of a different vessel. 
5.7 The operator has the right to change the cabin allocation depending on availability and the condition of the cabin for use. The Diver's Log is in no case responsible for cabin allocation.
5.8 In line with the industry norm, trips cancelled by the operator entitle you to a refund. Shortened trips entitle you to a proportionate refund, delayed trips to a choice of refund or re-scheduled trip, and lengthened trips have no extra charge. The operator assumes for responsibility for such incident, and The Diver's Log is in no case responsible and will not be part of any disputes.

6. Best Price Guarantee
6.1 We have an agreement with our operators to get the best price available, so you will get the lowest price possible at the time of booking. All basic prices displayed are prices provided by our operators.

6.2 The Diver's Log may run special promotions and discounts that are not related to our operators, and will no be found anywhere else.
6.3 If you find another Legit and/or Official website and/or agent providing lower rates, contact us directly and we will match the price. This needs to be contact before the departure date of your reservation.
6.4 You should be able to provide us all details of the other deals including a link to the website where it can be found. The deal should be for a same product (same boat, same dates, same cabins, same booking conditions, same included and excluded extras, etc.). If any part of the deal is different, The Diver's Log will not be able to match the price or modify the reservation that has been made.
6.5 Prices and availability are accurate in most cases. In some cases, the operator may not have supplied us with the updated information on dates, availability, and prices. We cannot be held responsible for that. When booking, please wait a confirmation email from The Diver's Log and/or the operator before payment.
6.6 If the deal you found through another website and/or provides special membership rates, loyalty programs or if the other agent doesn’t  clearly display rates on their website before you have requested them, our best price guarantee doesn’t apply. 

7. Liability
7.1 The reservation forms an agreement between the guest(s) and the operator. The Diver's Log only serves as an intermediary and cannot be held responsible for any deviations in the operators’ performance.
7.2 The guest agrees to never, in any case, hold The Diver's Log responsible for unforeseen circumstances. Liability waiver may need to be signed before entrance on the ship. The operator might not allow boarding if you do not agree to sign.
7.3 The Diver's Log is not responsible for delays of flights and/or transfer companies.
7.4 The Diver's Log is not accountable for different/wrong information published on partner websites.
7.5 Neither The Diver's Log, nor the operator, will be responsible for any losses you suffer (i.e any missed flights) due to failure to allow sufficient time for your journey.
7.6 The Diver's Log is not liable for, and will not be responsible, for personal injuries, property damage, or wrongful death that may occur during activities, as a result of the inherent risks associated with scuba diving, or any activity offered by the operator, or as a result of acts or omissions of other third parties.
7.7 The Diver's Log is not liable for changes in vessel used by the operator, changes in cabin appointments or any other changes in how the operator chooses to execute the booked trip.
7.8 In case The Diver's Log is held responsible for mistakes in the reservation services provided, the maximum liability shall not exceed the commission amount charged to the operator.
7.9 The Diver's Log and/or your operator are not responsible and cannot be held liable for delays, changes or cancellation of part or whole service due to acts of god, political unrest as well as military or civil conflicts and terrorist activities, ‘force majeure’, or due to other circumstances that are unforeseeable or beyond our control.

8. Complaints & Disputes
8.1 The Diver's Log only acts as the agent, we cannot be held responsible for the quality of the service provided by the operators. In case the guest is dissatisfied with the service provided, he/she should step up to the captain immediately to communicate the complaint.
8.2 We will channel complaints made after return into a constructive feedback and send it to operators to improve their services.
8.3 The law of the country in which the transportation took place, will apply to the relationship between the guest and the operator. Disputes between you and the operator will generally have to be settled by the court of the country in which the trip provided by the operator took place.
8.4 If the complaint is about the service provided by The Diver's Log (involving the website, payment collection and travel consultation), please submit your complaints through our contact form. We will do our very best to follow-up and help you, as your satisfaction is our top priority.

 

9. Miscellaneous
9.1 We take pride in protecting your personal information. Our policy regarding your privacy and how we use cookies on this website is outlined in our privacy policy.
9.2 All information on our website is believed to be correct at the time of publication. The Diver's Log will not be held responsible for any inaccuracies due to out-dated information provided to us by the operators.
9.3 By submitting a review, you grant The Diver's Log the full, transferable and irrevocable rights to it, including your name. We may use, translate, edit, or remove reviews at our sole discretion as we see fit.
9.4 All of the information on this website is copyrighted and is not allowed to be duplicated, copied or used for any commercial purpose without the explicit and written consent of The Diver's Log.
9.5 You are not allowed to  use, copy, display, download or reproduce any content on our website for any commercial or competitive activity or purpose. Our services are made directed for personal, non-commercial use only.
9.6 Safety standards and regulations comply with local standards and may differ from these in your home country. Enforcing these standards and/or regulations is a matter for the authorities in that country and the operator concerned.
9.7 The Diver's Log reserves the right to any possible altercation of prices and conditions.

If any section of these terms and conditions becomes invalid, you will remain bound by all other sections.
